About That Fine For Using Anti-Radar Apps

Let me get this straight: If I’m sitting next to a driver and playing Angry Birds on my iPhone, will this look like suspicious activity to a police officer? Will this give him the right to pull us over? Where does the burden of proof lie? Does he have to prove that I was using an anti-radar app, or is it my duty to show him that I was not?
Now the other angle. Suppose I was indeed using an anti-radar app and a police officer pulls me over. Can’t I just delete the app and claim that I was just playing Fruit Ninja and hope that the cuteness of the exploding watermelons will win him over?
Seriously, I can’t imagine any scenario where such a fine can be fairly applied. Which means that this law is simply meant to scare people, and is an extra weapon for luddite police officers to scold you for using your phone.
